Terms of Service
1. Acceptance
By accessing or using demoit.live (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Service. These Terms apply to anyone who uploads content, creates an account, or otherwise interacts with the Service, whether on a free or paid plan.
We may update these Terms from time to time. Material changes will be communicated via email (where we have an email address on file) or via a notice on the Service before the new Terms take effect. Continued use of the Service after a change constitutes acceptance of the updated Terms.
2. The Service
demoit.live is a hosting service for static HTML files, primarily
intended for mockups, prototypes, and small static sites. You upload a
file, we give you a URL on a content-isolation domain
(demoitusercontent.com) and serve it over our content
delivery network.
The Service is offered in free and paid tiers. Feature availability, storage quotas, file-size limits, and rate limits differ between tiers and are described on our pricing page. We may change these limits with reasonable notice.
3. Accounts
To use most features of the Service you must create an account by providing a valid email address and (for paid tiers) payment information. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must notify us promptly at security@demoit.live if you suspect any unauthorized use.
You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service under the supervision of a parent or legal guardian who has agreed to these Terms on your behalf.
4. Acceptable use
You may not use the Service, or permit anyone else to use it, for any of the following:
- Hosting content that is illegal under the laws of the United States or your local jurisdiction.
- Distributing malware, viruses, worms, trojans, ransomware, or any other malicious code; hosting cryptocurrency miners that run without the visitor’s informed consent.
- Phishing, credential harvesting, or any form of impersonation intended to deceive visitors about the identity or affiliation of the page.
- Content that sexually exploits or endangers minors, or any other content that is harmful to minors as defined by applicable law. We will report apparent child sexual abuse material to NCMEC and to law enforcement.
- Content that infringes the intellectual property, privacy, publicity, or other rights of others, including unauthorized reproduction of copyrighted works.
- Harassment, hate speech, incitement to violence, doxxing, or threats targeting individuals or protected groups.
- Using the Service to attack, probe, or interfere with the Service itself or any other system, including denial-of-service attacks, attempts to evade rate limits or quotas, or attempts to access accounts that are not yours.
- Using the Service as a backend or proxy for unrelated applications in a way that consumes disproportionate resources.
We may, at our discretion, refuse, remove, or disable access to any content that we believe violates these Terms or that exposes us, our infrastructure providers, or our users to legal or operational risk.
5. Your content
You retain all rights to the content you upload to the Service. We claim no ownership over your content. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, and serve that content for the purpose of operating and improving the Service. This license terminates when you delete the content or your account, except to the extent that caching or backup systems retain copies for a reasonable transition period.
You represent that you have the rights necessary to upload and publish the content you submit, and that doing so does not violate these Terms or any law.
6. Suspension and termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, if your use of the Service creates risk or legal exposure for us, or if we are required to do so by law. Where practical, we will give you notice and an opportunity to cure before terminating. For severe violations (such as content harmful to minors or active malware distribution), we may act immediately and without notice.
You may terminate your account at any time from your account settings. On termination, your hosted mockups will be removed from the Service. Some metadata may be retained for a limited period for legal, audit, or anti-abuse purposes.
7. Paid plans, billing, and refunds
Paid plans are billed in advance on a recurring basis (monthly or annually) via our payment processor. Subscriptions renew automatically until you cancel. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.
Fees are non-refundable except where required by law. If we materially reduce features available on your plan during a paid period, we will offer a pro-rated refund of unused service.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not offer an uptime guarantee for the free tier, and any uptime commitments for paid tiers are limited to what is explicitly stated in the pricing page or a separate written agreement.
You are responsible for keeping your own copies of any content you upload. We are not responsible for data loss, and we strongly recommend you keep originals on your own systems.
9. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim, or one hundred US dollars (USD $100), whichever is greater. For free-tier users, this means our liability is capped at USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability; in those jurisdictions, our liability is limited to the extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of content you upload, your use of the Service in violation of these Terms, or your violation of any third-party right.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service that the parties cannot resolve in good faith will be brought in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction and venue of those courts.
12. Changes to the Service
We may add, change, or discontinue features of the Service at any time. We will use reasonable efforts to give paid users advance notice of material reductions in functionality.
